Hope Nunekpeku, a 21-year-old commercial motorcycle rider, is facing charges of attempted robbery after being arrested while carrying a cutlass hidden in his shirt. During his trial at the Amasaman Circuit Court, Nunekpeku claimed he armed himself solely for self-defense, citing past experiences of motorbike theft.

The court, presided over by Ms. Enid Marful-Sau, heard that Nunekpeku was arrested on December 4, 2023, after a vigilant commercial bus driver reported suspicious activity to a nearby police patrol team. Nunekpeku was reportedly riding with an alleged accomplice, identified as Dickson, who managed to flee the scene with the motorcycle when the police arrived.

Nunekpeku denied having any criminal intentions during cross-examination, asserting that the cutlass was strictly for protection against potential threats while working as a motorcycle rider. He told the court that his previous encounter with bike thieves left him vulnerable, prompting him to carry the weapon. However, his defense was met with skepticism from the prosecution and arresting officers.

General Lance Corporal Samuel Boafo, one of the arresting officers, testified that the cutlass was discovered only after a search. He denied Nunekpeku’s claim that he informed the police of his reason for carrying the weapon during the arrest. “We only found the cutlass hidden under his shirt during a search,” Boafo told the court, dismissing Nunekpeku’s claim of transparency.

Detective Chief Inspector Enock K. Agorkpa, another witness for the prosecution, challenged Nunekpeku’s assertion that the weapon was for self-defense. He stated that Nunekpeku had ulterior motives for carrying the cutlass, emphasizing that the circumstances surrounding the arrest pointed to a planned robbery.

The incident reportedly occurred around 9:00 PM when Nunekpeku and Dickson were monitoring a commercial bus driver who had stopped to deliver items to his wife. The driver grew suspicious and confronted the pair, leading to Dickson fleeing into a dark area with the motorcycle. Alarmed, the driver called the police, resulting in Nunekpeku’s apprehension.

During the trial, Nunekpeku questioned the officers about their claims, asking whether he had used the cutlass to harm anyone or commit a crime. Both officers admitted that he had not directly used the weapon but maintained that his intentions were not innocent. Agorkpa suggested that the circumstances indicated an attempted robbery, adding weight to the prosecution's case.

The court ruled that a prima facie case had been established against Nunekpeku, requiring him to present a defense. The defendant’s claims of self-defense have sparked discussions about the challenges faced by commercial motorcycle riders, who often operate under precarious conditions. Many riders in Ghana, especially those in high-crime areas, have expressed concerns about their safety, leading some to take measures like carrying weapons.

Despite his explanation, the evidence presented by the prosecution paints a troubling picture. The circumstances, including Dickson’s escape and the hidden nature of the weapon, suggest premeditation rather than self-defense. The court’s decision will likely hinge on whether Nunekpeku’s actions were justifiable or part of a broader plan to commit a crime.

The case also underscores the importance of community vigilance and swift police response. The commercial bus driver’s alertness and timely action not only thwarted a potential crime but also led to the apprehension of a suspect.
